The General VPDES Permit for Discharges of Stormwater from Construction Activities is required for all construction activities that result in land disturbance equal to or greater than one acre, AND single-family detached residential structures that disturb less than one acre and are part of a common plan of development (e.g., subdivision).

The current permit expires on June 30, 2019, at midnight.

  • Operators with existing permit coverage that will continue land disturbance after June 30, 2019, must reapply for permit coverage through the VSMP authority no later than May 1, 2019.
  • There is no fee for reissuing permit coverage, however, DEQ will not reissue permit coverage until all incurred Annual Permit Maintenance fees are paid in full.
  • DEQ will finalize the 2019 VPDES Construction General permit in mid-April after the Spring State Water Control Board Meeting.
  • Several localities who are the VSMP authority have not finalized their process on how to issue permit renewals yet. RES is communicating with VSMP authorities weekly for updates and will relay this information to you to ensure continued permit coverage.

 

MAJOR CHANGES TO THE REGISTRATION PROCESS IN 2019

  • DEQ will accept registration statements via email or mail. If the VSMP authority is the county or city, they may still require ink-signed registration statements – RES is in constant contact with VSMP authorities across the state as they finalize their renewal process.
  • Nutrient credit purchases must be made prior to permit issuance.
  • Erosion and Sediment Control Plans and Stormwater Management Plans must be approved before permit registration. The Operator to provide the date that the plans were approved at permit registration.

 

WHAT OPERATORS CAN DO RIGHT NOW

  • Ensure all Annual Permit Maintenance fees are paid so permit coverage can be renewed.
  • RES is here to assist you in renewing permits and ensuring your continued compliance under the VPDES Construction General Permit. RES will reach out to coordinate with you and see which projects require continued permit coverage.
